What does this policy cover?

This policy describes how Nykaa Fashion Private Limited (also referred to as "Nykaa Fashion", "we" or "us") will make use of your data when you use our website (www.international.nykaafashion.com) or purchase goods and services from us.

We receive information from other sources, such as updated delivery and address information from our carriers, which we use to correct our records and deliver your next purchase more easily.

How do we use this information, and what is the legal basis for this use?

Who will we share this data with, where and when?

We will share your personal information with other Nykaa group companies (including FSN E-Commerce Ventures Limited, FSN Brands Marketing Pvt. Ltd.) to help provide you with products and services and support our administration.

Personal information may be shared with auditors, regulators, government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the legal protection of our legitimate interests in compliance with applicable laws.

Personal information will also be shared with third party service providers, who will process it on behalf of Nykaa Fashion for the purposes identified above.  Such third parties include providers of website hosting and maintenance, call centre operators, payment providers, delivery companies and identity checking providers.

In the event that the business is sold or integrated with another business, your details will be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business.

Cross-Border Data Transfer

Nykaa Fashion is headquartered in India and may have service providers in other countries. Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes, such as those set out above. Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that Nykaa Fashion disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of personal information we collected about you;
  • The categories of sources from which we collected personal information about you;
  • Our business or commercial purpose for collecting or selling that personal information;
  • The categories of third parties with whom we share that personal information; and
  • The specific pieces of personal information we collected about you (also called a data portability request).

Additionally, if we sold or disclosed your personal information for a business purpose, we will provide you with two separate lists disclosing:

  1. The categories of personal information Nykaa Fashion sold to third parties in the preceding twelve (12) months; and
  2. The categories of personal information Nykaa Fashion disclosed for a business purpose to third parties in the preceding twelve (12) months.

Deletion Request Rights

You have the right to request that Nykaa Fashion delete any of your personal information that it collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request in compliance with the CCPA if retaining the information is necessary for us or our service provider(s) to, among others: complete the transaction for which we collected the personal information, provide a good or service that you requested or take actions reasonably anticipated within the context of our ongoing business relationship with you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; comply with a legal obligation; or make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by:

  • Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The verifiable consumer request must:

 

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt.  If we require more time (up to 45 days), we will inform you of the reason and extension period in writing within the initial forty-five (45) days after receipt of the verifiable consumer request.

If you have an account with us, our written response to your verifiable consumer request will be delivered through such account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  For data portability requests, we will select a format that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

Any disclosures we provide pursuant to a verifiable consumer request will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt.  If applicable, our response will also explain the reasons we cannot comply with your request. 

We do not charge a fee to process or respond to your verifiable consumer request, unless such request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will inform you of the reasons of such decision and provide you with a cost estimate before completing your request.

 

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Shine the Light Law

You may request that we not share your information with certain affiliates or third parties providers for direct marketing purposes, and/or you may inquire as to how we have shared your information with third parties providers for direct marketing purposes.  In connection with such request, we will identify the types of information shared and provide you with the names and addresses of the third parties with whom the information was shared. 

If you would like to receive any such information, please contact us at support.intl@nykaafashion.com . Any such request must include “California Shine the Light Request” in the subject line and include your name, street address, city, state and ZIP code.  We will respond to your request within thirty (30) days of receipt of the same, and our response will cover any information shared with third parties for direct marketing purposes during the preceding twelve (12) months.  Please note that we are only required to respond to one request per customer each calendar year.
